The Gentle Return website, membership and associated products and services are operated by The Trustee for De Rose Family Trust trading as Studio Avasa (ABN 60 273 809 238), whose registered office is in Freshwater, Queensland, Australia.

The terms “us,” “our,” or “we” refer to The Trustee for De Rose Family Trust trading as Studio Avasa. The terms “you” or “your” refer to the website visitor, customer, member or user.

The Gentle Return offers products and services that may include:

  • online memberships and subscriptions;

  • live and recorded Kundalini Yoga classes and practices;

  • meditation and guided breath practices;

  • digital courses and workshops;

  • downloadable digital resources and educational products;

  • email newsletters, reflections and member communications;

  • blog content and educational resources; and

  • other online products, services and content offered through The Gentle Return from time to time.

Please read these Terms and Conditions carefully. Along with our Privacy Policy and Disclaimer, they outline your rights and responsibilities in relation to:

  2. your access to and participation in The Gentle Return memberships, services, programs and products.

By continuing to use this website, purchasing a product or service, or becoming a member of The Gentle Return, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please discontinue use of the website and our products and services.

1.1. By accessing this website and using our products or services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions, together with our Privacy Policy and Disclaimer.

4. Copyright, Trademarks and Other Intellectual Property

4.1. The Trustee for De Rose Family Trust trading as Studio Avasa owns, or has permission to use, the intellectual property rights in the original content published through The Gentle Return, including website content, membership materials, classes, recorded practices, digital courses, workshops, written materials, downloadable resources, graphics and other original materials.

4.2. Unless otherwise permitted by law, you may not copy, reproduce, record, display, distribute, modify, translate, adapt, publish, create derivative works from, sell, licence or otherwise exploit our content, in whole or in part, without our prior written permission.

4.3. If you wish to reproduce or use any of our content beyond the personal-use rights granted under these Terms and Conditions, please contact us at hello@studioavasa.com.au to request written permission.

4.4. Images, trademarks, music, teachings or other content displayed or used through The Gentle Return that belong to third parties remain the property of their respective owners and may be subject to separate copyright, trademark or other intellectual property rights.

4.5. You must obtain permission from the relevant rights holder before reproducing or using third-party content except where otherwise permitted by law. Any third-party names, product names, trademarks or other protected material remain the property of their respective owners.

5. Personal Use Only

5.1. Access to The Gentle Return website, membership and any purchased digital products or services is provided to you for your personal, non-commercial use only.

5.2. You may access or download materials where we have made those materials available for download. You must not copy, record, reproduce, share, distribute, sell, licence, publish or otherwise make available any The Gentle Return content or materials to another person without our prior written permission.

5.3. You agree not to alter, remove or obscure any copyright, trademark or proprietary notices contained within materials downloaded or accessed through The Gentle Return.

5.5. Your membership account and login credentials are for your individual use only. You must not share your login details, allow another person to access your membership account, or otherwise provide another person with access to membership content that they have not purchased or been authorised to access.

5.6. Live classes, recorded practices, meditations, breath practices, educational sessions and other membership content must not be recorded, reproduced or distributed by members unless we have expressly given permission to do so.

5.7. Your right to access membership-only content continues only for the period during which you have an active membership or for any additional access period expressly provided by us.

6. No Unlawful or Prohibited Use

6.1. As a condition of your use of The Gentle Return website, membership, products and services, you agree that you will not use them for any purpose that is unlawful, prohibited by these Terms and Conditions, or that infringes the rights of another person.

6.2. You must not use our website, membership platform or digital services in any way that could damage, disable, overburden or impair their operation, or interfere with another person's access to or use of them.

6.3. You must not attempt to gain unauthorised access to any part of our website, membership platform, accounts, systems or content that has not intentionally been made available to you.

6.4. You agree not to:

6.4.1. engage in spam or other similar activities through or in connection with our website or services;

6.4.2. use our website, membership, products or services for any unlawful purpose or in breach of these Terms and Conditions;

6.4.3. decompile, reverse engineer, copy or attempt to reproduce the underlying website, membership platform or digital content except where permitted by law;

6.4.4. knowingly introduce, transmit, distribute or link to computer viruses, malware, spyware or other harmful or malicious software;

6.4.5. collect or use information obtained through The Gentle Return for unsolicited direct marketing, including email, social media, SMS, telemarketing or direct mail; or

6.4.6. use information obtained through The Gentle Return to contact other members, customers, individuals, businesses or organisations for marketing or commercial purposes without their permission.

6.5. You must ensure that information you provide to us through our website, membership platform or in connection with our products and services is, to the best of your knowledge, accurate, current, complete and not misleading.

7. Memberships and Subscriptions

7.1. The Gentle Return is a subscription-based online membership providing access to a range of practices, resources and member content. This may include Kundalini Yoga practices, meditation, breath practices, live and recorded sessions, a practice library, monthly practices, educational content, reflections and other resources made available to members from time to time.

7.2. The Gentle Return is designed as an evolving membership. The content, practices, themes, live offerings, resources, format and other membership inclusions may develop and change over time. We may add, update, replace or remove content and features as the membership evolves.

7.3. Membership subscriptions are billed according to the billing cycle and price displayed at the time you join and will automatically renew unless cancelled before your next scheduled billing date.

7.4. By purchasing a recurring membership, you authorise the applicable payment provider to charge your nominated payment method for each recurring membership payment until you cancel your subscription.

7.5. You may cancel your membership at any time through your account settings, where available, or by contacting us at hello@studioavasa.com.au before your next scheduled billing date. Cancellation will prevent future membership payments. Any rights you may have to a refund or other remedy under the Australian Consumer Law or other applicable law are not affected.

7.6. Unless otherwise required by law or expressly stated at the time of purchase, cancellation does not provide a refund for the unused portion of a current paid membership period.

7.7. Following cancellation, you will ordinarily continue to have access to The Gentle Return until the end of your current paid membership period. Access to membership-only content will then cease.

7.8. Membership is provided for your individual, personal and non-commercial use. You must not share your login details, membership account, recordings, practices, resources or other membership-only content with another person.

7.9. Live sessions, recordings, monthly practices, library content and other resources may be available for different periods of time. Membership does not guarantee permanent access to any particular practice, recording, class, resource or item of content.

7.10. We may make reasonable changes to membership inclusions, content, schedules and features as The Gentle Return develops. Where a change materially affects the membership service, we will provide reasonable notice where practicable.

7.11. We may change the price of The Gentle Return membership from time to time. Any price change affecting an existing recurring membership will be communicated before the new price is charged, as required by applicable law.

7.12. We reserve the right to suspend or terminate membership access where a member materially breaches these Terms and Conditions, including through unauthorised sharing, reproduction or distribution of membership content.

7.13. Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

8. Copyright Infringement

8.1. If you believe that any material on The Gentle Return website, within The Gentle Return membership, or within any of our products or services infringes the intellectual property rights of a third party, please contact us at hello@studioavasa.com.au with sufficient information to enable us to investigate the matter and, where appropriate, remove or amend the relevant content.

9.1. The Gentle Return website uses cookies and similar technologies to support website functionality, enhance your browsing experience, analyse website traffic and improve our website and digital services.

The Gentle Return may rely on third-party platforms and service providers to deliver aspects of the website, membership, live sessions, recordings, payments, communications and other digital services. Temporary interruptions, delays, outages or technical issues may occasionally affect access to these services.

11.4. Where a technical issue within our reasonable control materially affects access to a paid product or service, we will take reasonable steps to restore access or otherwise address the issue as appropriate.

12. Limitation of Liability

12.1. To the fullest extent permitted by law, we will not be liable for any loss, damage, cost or expense arising out of or in connection with your use of The Gentle Return website, membership, products or services, except to the extent that liability cannot lawfully be excluded or limited.

12.2. The Gentle Return provides general educational and wellbeing content and does not guarantee any particular outcome or result from participation in the membership, practices, programs, products or services. Individual experiences and outcomes may vary.

12.3. Where any consumer guarantee, warranty or other right is implied or imposed by law and cannot lawfully be excluded, our liability will be limited only to the extent permitted by law.

Where permitted, this may include:

  • the resupply of the relevant products or services; or

  • the payment of the reasonable cost of having the products or services supplied again.

12.4. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law or any other applicable legislation that cannot lawfully be excluded, restricted or modified.

12.5. Your participation in Kundalini Yoga, meditation, breath practice, movement and other practices offered through The Gentle Return is also subject to our Disclaimer.

12.6. This section survives the cancellation or termination of your membership and the termination or expiry of these Terms and Conditions to the extent permitted by law.

13. Indemnity

13.1. To the extent permitted by law, you agree to indemnify us against reasonable loss, liability, damage, cost or expense arising directly from:

13.1.1. your unlawful or unauthorised use of The Gentle Return website, membership, products, services or content;

13.1.2. your material breach of these Terms and Conditions; or

13.1.3. your infringement of our intellectual property rights or the rights of a third party through your use or distribution of The Gentle Return content.

13.2. Nothing in this section is intended to exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

14. Applicable Law

14.1. These Terms and Conditions are governed by the laws of the State of Queensland, Australia. You submit to the jurisdiction of the courts of Queensland in relation to any dispute arising out of or in connection with these Terms and Conditions or your use of The Gentle Return website, membership, products or services, subject to any rights you may have under applicable consumer law.

14.3. We may provide notice to you by email or other electronic means using the contact details you have provided to us.

14.4. If you access The Gentle Return from outside Australia, you are responsible for complying with any laws applicable to you in your location, to the extent those laws apply.

15. Relationship

15.1. Nothing contained in these Terms and Conditions, or arising from your use of The Gentle Return website, membership, products or services, creates any joint venture, partnership, employment, agency or fiduciary relationship between you and The Trustee for De Rose Family Trust trading as Studio Avasa.

16. Validity and Entire Agreement

16.1. If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.

16.2. These Terms and Conditions, together with our Privacy Policy and Disclaimer and any additional terms expressly provided in connection with a particular product or service, form the agreement between you and us in relation to your use of The Gentle Return website, membership, products and services.
